Version 1.0 ยท Effective 10 October 2026
1. About this policy
This policy is published by Arellis Energy Pty Ltd (ACN 702 444 960) ("Arellis Energy", "we", "us" or "our"). We develop battery energy storage projects in South Australia.
Whether or not the Privacy Act 1988 (Cth) applies to us at any particular time, we have chosen to handle personal information in line with the Australian Privacy Principles (APPs) in that Act.
"Personal information" means information or an opinion about an individual who is identified or reasonably identifiable. Information about land, such as its address or title details, is personal information when it is linked to an owner who is an individual.
2. Who this policy applies to
This policy applies to personal information about:
- landowners and occupiers, and people acting for them;
- neighbours and members of the community near our sites or proposed sites;
- people who work for investors, financiers, purchasers, partners, suppliers, contractors and consultants;
- job applicants; and
- people who visit our website or contact us.
3. What personal information we collect
We collect only what we reasonably need. Depending on how you deal with us, this may include:
- Landowners and occupiers: Name and contact details; property address, title reference and land details; who owns the land (including company or trust details); information you give us about the land and how it is used; our correspondence and meeting notes. If we sign an option, lease or access agreement with you: the agreement, your bank account details for payments, and ABN and GST status where relevant.
- Neighbours and community members: Name, contact details and any questions, comments or feedback you give us.
- Investors, financiers, purchasers and partners: Name, role, organisation, contact details and our correspondence.
- Suppliers, contractors and consultants: Name, contact and business details, payment details, and information about qualifications and insurance.
- Job applicants: Your application, CV, contact details, qualifications and referee details.
- Website visitors: Anything you enter into a form on our website, and technical information such as IP address, browser and device type, and pages visited (see section 10).
Sensitive information. We do not ask for sensitive information (such as health information, or information about racial or ethnic origin, religion or political opinions). If we ever need it, we will collect it only with your consent and where it is reasonably necessary, or where the law allows.
4. How we collect personal information
Mostly, we collect it directly from you: through our website forms, by email or phone, at meetings and site visits, and through agreements you sign with us.
We may also collect it from other sources, including:
- public registers, such as land title and property records (through Land Services SA), the ASIC register and ABN Lookup;
- planning and council records;
- real estate agents, introducers, project partners and professional advisers; and
- other publicly available sources.
If we collect information about you from someone else, we will take reasonable steps to let you know, unless it is obvious from the circumstances.
If we receive personal information we did not ask for and could not have collected under this policy, we will destroy or de-identify it where it is lawful and reasonable to do so.
5. Why we collect, use and hold personal information
We use personal information to:
- respond to your enquiry;
- assess whether land may be suitable for a battery energy storage project;
- negotiate, prepare and manage options, leases and access arrangements, and make payments under them;
- apply for approvals, including development approval and network connection;
- consult with neighbours and the local community;
- run our business, including dealing with suppliers and contractors, accounting, insurance, legal matters and recruitment;
- raise finance for, bring partners into, or sell our projects (see section 7);
- send you updates about our work, if you have agreed to receive them (see section 9); and
- comply with the law and resolve disputes.
We will not use your personal information for an unrelated purpose unless you agree or the law allows it.
6. Who we share personal information with
We share personal information only where needed for the purposes above. This may include:
- our project partners, and the companies and trusts we set up to hold individual projects;
- SA Power Networks, the Australian Energy Market Operator and other network or market bodies, where needed to connect or register a project;
- planning authorities, councils and government agencies;
- our professional advisers, such as lawyers, accountants, surveyors, engineers, planners, valuers and environmental and acoustic consultants;
- financiers, investors and prospective purchasers of our projects, on a confidential basis;
- service providers who support our business, such as email, cloud storage, website hosting and payment providers; and
- anyone you authorise, or where the law requires or allows it.
7. When a project is financed or sold
Financing projects, bringing in partners and selling projects is a normal part of our business. When this happens, a financier, partner or buyer may need to see project records, including option and lease agreements with landowners.
If a project is sold, the new owner takes over the relevant agreements and will hold the related landowner information.
8. Information held or sent outside Australia
Some of our service providers, such as our email, cloud storage and website hosting providers, may store or process personal information outside Australia, including in the United States.
Some financiers, investors or purchasers of our projects may be based overseas. Before sharing personal information with anyone outside Australia, we take reasonable steps to make sure they handle it consistently with the APPs, including through confidentiality and contract terms.
9. Updates and direct marketing
We will send you updates or marketing material only if you have agreed to receive them or the law otherwise allows it. Every marketing email or text message we send will identify us and include a simple way to unsubscribe.
You can opt out at any time by using the unsubscribe link or by emailing us. Opting out does not stop us contacting you about an agreement or matter you have with us.
10. Our website, cookies and analytics
Our website uses cookies and similar technologies to make the site work and to help us understand how it is used. These may include analytics tools that show us how visitors find and use the site, tools that run our contact and sign-up forms, embedded content such as maps or videos, and tools that protect the site from spam and misuse. Some of these are provided by third parties, including our website hosting and website builder provider, who may set their own cookies and collect technical information such as your IP address, browser and device type, and the pages you visit. That information may be stored outside Australia (see section 8).
Information you submit through a website form is sent to us and stored in our systems.
11. Use of software tools in decision-making
We use spreadsheets and software tools to help us assess and compare potential sites.
Where land is owned by an individual, these tools may use personal information such as the property address, title and ownership details, and proposed option or lease terms. The results help our team decide which sites to pursue, which can affect whether we offer an option or lease for your land.
A person in our team always makes the final decision. We do not otherwise use computer programs to make, or to substantially assist in making, decisions that could significantly affect individuals.
12. How we store and protect personal information
We store personal information mainly in secure cloud-based systems, with limited paper records. We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, change or disclosure.
We keep personal information only for as long as we need it for the purposes in this policy, or as long as the law requires. We destroy or de-identify personal information we no longer need.
13. Data breaches
Where the Notifiable Data Breaches scheme applies to us and a breach is likely to result in serious harm, we will notify the people affected and the Office of the Australian Information Commissioner (OAIC).
14. Accessing and correcting your personal information
You can ask to see the personal information we hold about you, or ask us to correct it, by emailing us (see section 17). We will need to confirm your identity first.
- We will respond within a reasonable time.
- There is no charge to make a request. In the rare case that giving access involves substantial cost, we may charge a reasonable fee.
- If we refuse access, we will tell you why in writing and how you can complain, unless it would be unreasonable to do so.
- If information is inaccurate, out of date, incomplete, irrelevant or misleading, we will correct it. If we disagree that it needs correcting, we will tell you why, and you can ask us to keep a statement with the record saying you believe it is wrong.
15. Dealing with us anonymously
You can make a general enquiry without giving your name, or by using a pseudonym. We will need to know who you are before we can discuss or enter into an agreement about land.
16. Complaints
If you have a concern about how we have handled your personal information, please email our Privacy Officer with the details. We will look into your complaint and respond within a reasonable time.
If you are not satisfied with our response, you may be able to make a complaint to the Office of the Australian Information Commissioner: www.oaic.gov.au or 1300 363 992.
